These Terms and Conditions (“Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of these Terms and Conditions and by participating in this promotion (the “Promotion”) all entrants will be deemed to have accepted and be bound by these Terms and Conditions. Please retain a copy for your information.

The promotion

Eligibility

1.    The Promotion is open to residents of the UK aged 18 (eighteen) years or over, excluding the employees and immediate families of the Promoter, its affiliated companies, distributors, agents or anyone else professionally connected to the Promotion

2.    Purchase is necessary and access to the Internet is required. Entrants will require an active genuine e-mail address which must be available for the duration of the Promotion to enter. No Purchase Necessary for Northern Ireland – see clause 7 below.

Promotional Period

3.    Entry to the main Promotion will be open between 00:00 BST on 09.07.18 and 23:59 BST on 30.09.18 (the “Main Promotional Period”). There will also be a Catch-all draw on 02.07.19 for all non-winning entries received during the Main Promotional Period and all entries received after the closing date of the Main Promotional Period up until 30.06.19 – see clauses 13 and 25 below.

Entry

4.    Buy any ‘Hit a Wicket, Win an England Cricket Ticket’ Promotional product of Rubicon (“Promotional Product”) and visit rubiconcricket.co.uk. Submit the last 4 (four) digits of the Promotional Product barcode and enter the following required personal information on the Promotion entry form: full legal name and e-mail address. Entrants will need to confirm acceptance of the Terms and Conditions and that they’re aged 18 (eighteen) years or over in order to submit their entry. Entrants will be prompted to “bowl at the wickets” via an interactive video housed on rubiconcricket.co.uk. Entrants will immediately receive a notification on-screen to confirm their entry has been successful and if they are a winner. Winning entrants will be asked to follow the on-screen instructions to claim their Prize.

6.    Maximum of 1 (one) entry per person, per day. Strictly 1 (one) email address per person allowed. 
 

7.    No Purchase Necessary route for Northern Ireland residents only. Request a 4 (four) digit barcode by writing to the Promoter at Rubcion Cricket Promotion - No Purchase Route, Rubicon team, A.G. BARR p.l.c., Westfield House, 4 Mollins Road, Cumbernauld G68 9HD. The letter must include the entrant’s full name and full postal address including country of residence. No purchase necessary requests may be subject to verification. Only correctly stamped, valid requests will receive a code that can be used to enter the Promotion. The code will be posted to the address supplied in the request letter.  (one) letter per person per week via this route. No Purchase Necessary requests must be received by 09.06.19.
 

8.    No Purchase Necessary requests will be rejected if they:

  1. Contain defamatory, malicious, indecent or other inappropriate content;
  2. Include the names, likenesses, or similar of any individual without their express permission;
  3. Refer to any brand other than Rubicon; or
  4. Represent a danger to health and safety.

9.    Each entry into the Promotion must be made using the last 4 (four) digits of the barcode from a Promotional Product. 1 (one) 4 (four) digit barcode equals 1 (one) entry. Please note that whilst the Promoter wants to encourage you to participate and enjoy the benefits of the Promotion, the Promoter believes in responsible consumption of its products. DO NOT purchase more Promotional Product than you can reasonably consume just to participate in this Promotion.
 

10.    Only genuine barcodes printed on Promotional Products can be used. Codes have no value and cannot be sold or transferred. Any attempts to undermine the use of genuine codes in this Promotion will mean disqualification of entry.

The prize

Prize

11.    During the Main Promotional Period, there will be a total of 84 prizes (“Prizes”) to be won – each Prize being allocated to a “winning moment”.
 

12.    The Prizes include the following tickets to the following England v India cricket fixtures:

  • 4 x pairs of tickets to the ODI at Emerald Headlingley on 17 th July 2018
  • 7 x pairs of tickets to the 1 st Test (Day 2) at Edgbaston on 2 nd August 2018
  • 5 x pairs of tickets to the 1 st Test (Day 3) at Edgbaston on 3 rd August 2018
  • 12 x pairs of tickets to the 2 nd Test (Day 2) at Lord’s on 10 th August 2018
  • 5 x pairs of tickets to the 3 rd Test (Day 3) at Trent Bridge on 20 th August 2018
  • 5 x pairs of tickets to the 3 rd Test (Day 5) at Trent Bridge on 22 nd August 2018
  • 5 x pairs of tickets to the 4 th Test (Day 2) at the Ageas Bowl on 31 st August 2018
  • 5 x pairs of tickets to the 4 th Test (Day 3) at the Ageas Bowl on 1 st September 2018
  • 5 x pairs of tickets to the 5 th Test (Day 1) at KIA Oval on 7 th September 2018
  • 5 x pairs of tickets to the 5 th Test (Day 2) at KIA Oval on 8 th September 2018
  • 26 x pairs of tickets to a domestic England fixture during the 2019 season (excluding Ashes tickets). The Promoter will confirm the fixtures to the winners.

13.    There will be a ‘Catch-all Draw’ 9 (nine) months after the Main Promotional Period has ended for all non-winning entries received during the Main Promotional Period and all entries received after the closing date of the Main Promotional Period up until 30.06.19. The Catch-all Draw will take place on 02.07.19 and will be for 1 (one) x pair of tickets to a domestic England fixture during the 2019 season (excluding Ashes tickets). The Promoter will confirm the fixture to the winner.
 

14.    The Prize does not include any additional elements such as travel expenses, food & drink or spending money.
 

15.    The Prize must be taken as stated and no compensation will be payable if any part is unused.
 

16.    Prizes are date specific, no alternative is available.
 

17.    Only 1 (one) x Prize per person.

Winner Selection and Notification

18.    There will be 1 (one) x winning moment per day during the Main Promotional Period. A day of the main Promotion runs from 00.01 to 23.59. Winning moments have been selected by an electronic independent verification service. The first valid Promotion entry on or after that Promotional day’s winning moment will be awarded the Prize. If no entry is received between 1 (one) winning moment to the next, the Prize from that Promotional day will be rolled over into the following Promotional day, creating an additional winning moment. If no entry is received for more than 48 (forty-eight) hours after a winning moment, the Promoter reserves the right not to award the Prize for that winning moment.
 

19.    Winners will be notified immediately on-screen as described in clause 4 above and asked tosubmit a postal address to which their Prize will be delivered. Winners will also be asked for a contact telephone number.
 

20.    Winners will also be notified with a confirmation email. This email will include customer service contact information for any Prize and fulfilment related queries. It is the responsibility of entrants to check junk/SPAM to ensure they are in receipt of Promotional communications.
 

21.    It is the responsibility of the winners to provide their correct, up-to-date details at the time of acceptance in order for their Prize to be processed. Neither the Promoter nor its fulfilment agent will be held responsible for non-delivery of the Prize caused by the provision of wrong information. In the event of no winner responding to claim a Prize, the Promoter reserves the right to not award the Prize.
 

22.    Please allow up to 4 (four) working days from the date of receipt of the Prize confirmation email (see clause 20 above) for delivery of the Prize although the Promoter will endeavour to send these out sooner.
 

23.    Prizes that are undelivered or returned to sender will be deemed unwanted and the Prize will be forfeited. The Prize will not be re-allocated.
 

24.    No responsibility can be taken for entries or claims which are misdirected, lost, delayed, damaged or corrupted during delivery to or from the Promoter due to any computer malfunction, virus, bug, delay or other reason whatsoever. The Promoter is not responsible for any wrong information supplied to the Promoter by a winner in seeking to claim his/her Prize.
 

25.    A prize draw will take place on 02.07.19 to select a winner for the Catch-all Draw. This random prize draw will be performed by an independent third party. The winner will be notified via email within 5 (five) working days of the draw date.
 

26.    All potential winners are subject to verification of eligibility and compliance with these Terms and Conditions. Part of this process may include questions during the claim process and a review of personal information sourced from data available in the public domain.
 

27.    Unless agreed otherwise, Prizes are non-transferable. There are no cash or alternative prizes available in whole or in part, except that the Promoter reserves the right to substitute a Prize with an alternative prize of equal or greater monetary value in the event of circumstances outside its control.
 

28.    Winners will release the Promoter and their affiliates, partners and employees from any and all liability, claims, demands and causes of action for personal injury and or damage, theft or loss suffered in connection with this Promotion save where due to negligence of the Promoter or its affiliates, partners or employees.

Data Protection

29.    The Promoter will collect personal information for the purpose of administering this Promotion. In administering this Promotion any personal data relating to entrants will be used solely in accordance with current country data protection legislation and, other than in connection with the running of this Promotion, validation of the data and any administration of the Prize, will not be disclosed to a third party without the individual’s prior consent. Personal data related to entrants will be retained for a maximum of 6 (six) months following the Catch-all Draw. Personal data related to winners will be passed to a fulfilment agency and will be retained by the Promoter and its fulfiment agency for a maximum of 6 (six) months following notification of their Prize win.
 

30.    Any information collected regarding entrants into this Promotion will be treated in confidence in accordance with the Promoter’s Privacy Policy.

General

31.    The Promoter is not responsible or liable for:

  • Any entries/claims that are lost or delayed due to faulty, failed or erroneous electronic data transmissions.
  • Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion causing delays or disruption.
  • Claims/entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of posting will not be accepted as proof of receipt.
  • Any material harm or non-pecuniary damage caused to the entrants, their computer equipment and the data stored on it or for the consequences thereof on their personal or business activities.
  • Non-delivery of the Prize caused by the supply of wrong information by the winner, postal disputes or other causes beyond its control.
  • Any costs that have not been mentioned in these Terms and Conditions.

32.    To the fullest extent permissible by law, neither the Promoter nor its affiliated companies, or subsidiaries, will be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the Promotion or use of any Prize.
 

33.    Winners’ first name, last name and county of residence will be available by sending a stamped address envelope clearly marked “FAO Rubicon Brand Manager – Rubicon Cricket Promotion” with details of your request to: A.G. BARR p.l.c., Westfield House, 4 Mollins Road, Cumbernauld G68 9HD within 3 (three) months of the end of: (i) the Main Promotional Period in the case of the winners of the main Promotion; and (ii) the Catch-all Draw in the case of the winner of the Catch- all Draw. When contacting this address, your request will be actioned in line with the the Promoter’s Privacy Policy.
 

34.    No bulk entries, entries from agents, third parties, syndicates, organised groups or entries automatically generated by a computer programme, application, script or any automatic method will be accepted. Any person trying to circumvent this condition by any method, including but not limited to using multiple aliases, e-mail accounts or IP addresses will be immediately disqualified along with all entries from associated accounts. Only genuine valid codes will be entered and will be considered.
 

35.    Anyone, in the Promoter’s absolute discretion, who is acting in a manner that undermines the operation and integrity of the Promotion or in any way that gives an unfair advantage, will be disqualified.
 

36.    Incomplete, illegal, misdirected or late entries will not be accepted.
 

37.    All entries will be strictly monitored by the Promoter throughout the Promotion and any attempts to manipulate or otherwise unfairly influence the Promotion will result in disqualification of entry or suspension of the Promotion.
 

38.    The Promoter will have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid entries including, without limitation, to require further verification as to the identity, age, and other relevant details of an entrant and their entry patterns.
 

39.    The Promoter will have sole and final determination as to which entries are genuine and therefore eligible to take part in this Promotion and no correspondence will be entered into.
 

40.    Winners’ details may be disclosed as per clause 33. In addition, winners acknowledge that they may be required to take part in unpaid promotional activity related to the Promotion (including, for example, a photo or video shoot) and that the Promoter may use winners' names, voices, and images for its promotional purposes in any medium without making any payment to winners.
 

41.    In the event of circumstances outside the Promoter's reasonable control and only where circumstances make this unavoidable, the Promoter reserves the right to cancel, suspend or amend the Promotion or these Terms and Conditions at any stage but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.
 

42.    The Promoter reserves the right to verify all entries including but not limited to asking for address, proof of purchase with the relevant barcode, contact telephone number and identity details. The Promoter also reserves the right to require that winners undergo reasonable due diligence checks that could include verification of various personal details and agreement to and submission of a confidential background check.
 

43.    The Promoter's decision is final and binding in all Promotional matters.
 

44.    The Promotion and these Terms and Conditions will be governed by the laws of Scotland and any disputes arising out, or in connection with, these Terms and Conditions will be subject to the exclusive jurisdiction of the Scottish courts.
 

45.    If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it will be severed and deleted from these Terms and Conditions and the remaining clauses will survive and remain in full force and effect.
